These Terms of Service constitute a legally binding agreement between you and KLM Enterprises Services LLC, operating The Underlinks through theunder.us (“The Under,” “The Underlinks,” “Company,” “we,” “us,” or “our”).

These Terms govern your access to and use of theunder.us and any related accounts, memberships, pages, profiles, analytics, referral tools, contests, advertisements, subscriptions, and services.

1. Acceptance of the Terms

By visiting the website, creating an account, purchasing a service, uploading content, or otherwise using The Underlinks, you agree to:

  • These Terms of Service;

  • Our Data Policy;

  • Our Cookie Policy;

  • Any plan, promotion, contest, advertising, or feature-specific rules presented to you.

Do not use the service if you do not agree to these Terms.

2. Eligibility

You must be at least 13 years old to use The Underlinks.

If you are under the legal age of majority in your location, you may use the service only with permission and supervision from a parent or legal guardian who agrees to these Terms.

You must be legally capable of entering into a binding agreement to purchase a subscription, advertisement, or other paid service.

You may not use the service if:

  • You are prohibited from doing so by law;

  • Your previous account was permanently removed for serious violations;

  • You are acting on behalf of a person or organization without authorization.

3. Accounts

Certain features require an account.

You agree to:

  • Provide accurate and current information;

  • Maintain only accounts you are authorized to control;

  • Keep your login credentials confidential;

  • Use a valid email address;

  • Complete required account verification;

  • Promptly update inaccurate information;

  • Notify us of suspected unauthorized access;

  • Accept responsibility for activity conducted through your account.

You may not:

  • Impersonate another person or organization;

  • Create accounts using false or misleading information;

  • Purchase, sell, transfer, or share accounts without permission;

  • Circumvent email-verification, account-blocking, or security controls;

  • Use automated systems to create accounts;

  • Register accounts for spam, fraud, or manipulation.

We may require additional verification before allowing access to sensitive features.

4. The Underlinks Services

The Underlinks may provide:

  • Custom link pages;

  • Business and creator profiles;

  • Digital landing pages;

  • Website and social-media linking tools;

  • Content-sharing tools;

  • Analytics and engagement reports;

  • Referral tools;

  • Contest or promotional features;

  • Advertising services;

  • Membership and subscription plans;

  • Music, media, product, event, or business promotion;

  • Other digital services made available through the website.

Features may vary by account, plan, location, device, or availability.

We may add, change, suspend, or discontinue features when reasonably necessary. We do not guarantee that every feature will remain available permanently.

5. Free and Paid Plans

The website may offer free accounts, paid plans, one-time purchases, promotional offers, or recurring subscriptions.

Before completing a paid transaction, users should be shown applicable:

  • Price;

  • Billing frequency;

  • Included features;

  • Usage limits;

  • Renewal terms;

  • Trial terms;

  • Cancellation method;

  • Material restrictions.

Features available under one plan may not be available under another.

We may modify plan features or prices prospectively. Price changes will not be applied retroactively to an already completed one-time purchase.

6. Recurring Subscriptions

When a plan is identified as recurring, you authorize the applicable payment provider to charge the selected payment method at the disclosed interval until the subscription is canceled.

Recurring plans may renew automatically unless canceled before the next billing date.

You are responsible for:

  • Reviewing the price and billing frequency before purchase;

  • Keeping billing information current;

  • Canceling before the next renewal charge when you do not want the service renewed;

  • Reviewing account and payment-provider notices.

Where available, subscriptions may be canceled through the account dashboard or by contacting support@theunder.us.

Cancellation generally takes effect at the end of the current paid billing period unless the checkout terms or applicable law provide otherwise.

7. Payments, Taxes, and Failed Charges

Prices will be displayed before purchase.

You authorize us and our payment providers to:

  • Process authorized charges;

  • Validate payment information;

  • Retry failed recurring charges where permitted;

  • Apply credits or refunds;

  • Maintain transaction records;

  • Use fraud-prevention controls.

You are responsible for applicable taxes, duties, or governmental charges unless the checkout page states that they are included.

We may suspend paid features after a payment failure, chargeback, reversal, or expired payment method.

We may require payment of an undisputed outstanding balance before restoring service.

8. Refunds

Except where required by law or expressly stated in a specific offer:

  • Completed payments are nonrefundable;

  • Subscription fees are not prorated;

  • Unused features, traffic, impressions, or account time do not create a refund entitlement;

  • Removing content or closing an account does not automatically create a refund.

Approved refunds will generally be returned through the original payment method.

Fraudulent chargebacks, false disputes, or abuse of refund procedures may result in account suspension or termination.

Nothing in this section limits rights that cannot legally be waived.

9. User Content and Ownership

You retain ownership of content that you create and upload, subject to the rights granted in these Terms.

“User Content” includes:

  • Text;

  • Names;

  • Biographies;

  • Links;

  • Images;

  • Logos;

  • Graphics;

  • Audio;

  • Video;

  • Documents;

  • Advertisements;

  • Promotions;

  • Product or service information;

  • Contest submissions;

  • Other materials submitted through an account.

You represent that:

  • You own the content or have permission to use it;

  • You have the right to publish it;

  • It does not violate another party’s intellectual-property, privacy, publicity, contractual, or legal rights;

  • It is not deceptive, unlawful, or harmful.

10. License to Operate the Service

By uploading or publishing User Content, you grant KLM Enterprises Services LLC a nonexclusive, worldwide, royalty-free license to:

  • Host;

  • Store;

  • Copy;

  • Process;

  • Display;

  • Reproduce;

  • Format;

  • Resize;

  • Transcode;

  • Distribute;

  • Make technically necessary modifications to the content.

This license is limited to operating, promoting, protecting, and improving The Underlinks and displaying the content as directed by you.

The license continues for as long as the content remains on the service and for a reasonable period in backups, logs, legal records, and technical systems after deletion.

You are responsible for keeping independent backups of important content.

11. Public Pages and Links

Content published on a public page may be:

  • Viewed without an account;

  • Shared by visitors;

  • Indexed by search engines;

  • Embedded or linked elsewhere;

  • Captured in screenshots;

  • Stored in third-party caches.

We cannot guarantee complete removal of copies created or retained by unrelated third parties.

You are responsible for verifying links and ensuring that linked destinations are safe, lawful, and accurately described.

12. Prohibited Conduct

You may not use The Underlinks to:

  • Violate any applicable law or regulation;

  • Commit fraud or identity theft;

  • Impersonate another person, company, government agency, or brand;

  • Publish false, deceptive, or materially misleading information;

  • Distribute spam or unauthorized commercial messages;

  • Conduct phishing or credential theft;

  • Upload malware, ransomware, spyware, or malicious code;

  • Attempt unauthorized access to an account, server, database, or network;

  • Circumvent subscriptions, permissions, security restrictions, or usage limits;

  • Manipulate analytics, referrals, clicks, contest entries, or advertising results;

  • Use bots, scripts, click farms, or automated traffic without permission;

  • Promote illegal goods, services, or transactions;

  • Exploit or endanger children;

  • Publish nonconsensual intimate content;

  • Threaten, stalk, harass, or defame others;

  • Promote violence or credible threats;

  • Infringe copyrights, trademarks, publicity rights, or other intellectual-property rights;

  • Collect personal information without authorization;

  • Upload highly sensitive personal information belonging to another person;

  • Interfere with the operation or performance of the service;

  • Resell or commercially exploit the platform without authorization;

  • Copy, reverse engineer, or attempt to extract protected source code except where such restrictions are prohibited by law.

13. Content Review and Enforcement

We may, but are not required to, review, restrict, reject, remove, or disable content that we reasonably believe:

  • Violates these Terms;

  • Violates the law;

  • Creates a security or fraud risk;

  • Infringes another party’s rights;

  • Threatens users or the platform;

  • Is connected with a payment dispute;

  • Is materially misleading;

  • Could expose the company to legal liability.

We may use automated and manual systems to detect spam, fraud, abuse, or technical threats.

Our decision not to remove particular content does not mean that we endorse it.

14. Referrals, Contests, and Promotions

Referral programs, contests, giveaways, and promotions may be subject to separate official rules.

Those rules may address:

  • Eligibility;

  • Geographic limitations;

  • Start and end dates;

  • Entry requirements;

  • Referral qualification;

  • Fraud prevention;

  • Winner selection;

  • Prizes;

  • Taxes;

  • Verification;

  • Disqualification.

Automated entries, fake accounts, duplicate identities, purchased traffic, self-referrals, click manipulation, and other abusive activity may be disqualified.

When feature-specific rules conflict with these Terms, the feature-specific rules control for that promotion.

15. Advertising Services

Advertisements may require review and approval.

We may reject, pause, remove, or decline advertisements that:

  • Violate the law;

  • Contain malware;

  • Are deceptive;

  • Infringe rights;

  • Misrepresent a product or service;

  • Create a safety risk;

  • Violate payment-provider or platform requirements;

  • Conflict with our advertising standards.

Unless expressly guaranteed in writing, purchasing advertising does not guarantee a specific number of sales, customers, followers, entries, conversions, or business results.

Reported impressions, views, and clicks may be adjusted to exclude suspected bots, duplicate activity, invalid traffic, or fraud.

16. Third-Party Services

The Underlinks may link to or integrate with independent:

  • Websites;

  • Social networks;

  • Music platforms;

  • Video platforms;

  • Payment providers;

  • Analytics providers;

  • Advertising networks;

  • Applications;

  • Embedded media;

  • Business services.

We do not control and are not responsible for third-party:

  • Content;

  • Availability;

  • Accuracy;

  • Security;

  • Privacy practices;

  • Products;

  • Transactions;

  • Terms;

  • Business conduct.

Use third-party services at your own discretion and review their policies.

17. Intellectual Property

The Underlinks website, software, design, branding, databases, text, graphics, logos, and other company materials are owned by or licensed to KLM Enterprises Services LLC.

Except as permitted by law or written authorization, you may not:

  • Copy;

  • Sell;

  • License;

  • Republish;

  • Modify;

  • Distribute;

  • Reverse engineer;

  • Create derivative works from protected company materials.

No provision of these Terms transfers ownership of company intellectual property to a user.

18. Copyright and Rights Complaints

A person who believes content on The Underlinks infringes their rights may send a complaint to support@theunder.us.

The complaint should include:

  • Identification of the protected work;

  • Identification and location of the disputed content;

  • The complainant’s name and contact information;

  • A statement explaining the claimed violation;

  • A good-faith statement that the disputed use is unauthorized;

  • A statement that the information supplied is accurate;

  • A physical or electronic signature.

We may request additional information before acting.

Submitting a knowingly false complaint may create legal liability.

19. Suspension and Termination

We may restrict, suspend, or terminate an account when we reasonably believe:

  • These Terms were violated;

  • The account creates a security threat;

  • The user engaged in fraud or abuse;

  • Required payments remain unpaid;

  • A payment was reversed or disputed;

  • The account violates a legal requirement;

  • Continued service creates substantial legal or operational risk.

Where appropriate, we may provide notice or an opportunity to correct the issue. Immediate action may be taken for fraud, security incidents, illegal conduct, serious abuse, or threats.

Users may close their accounts through available account controls or by contacting support.

Termination does not eliminate outstanding payment obligations or provisions that logically survive termination.

20. Service Availability

We work to maintain reliable service but do not guarantee uninterrupted or error-free access.

The service may be unavailable because of:

  • Maintenance;

  • Updates;

  • Hosting failures;

  • Internet disruptions;

  • Security events;

  • Third-party outages;

  • Legal requirements;

  • Events outside our reasonable control.

We are not responsible for losses caused solely by temporary unavailability except where liability cannot legally be excluded.

21. Disclaimer of Warranties

To the maximum extent permitted by law, The Underlinks is provided on an “as is” and “as available” basis.

We disclaim implied warranties of:

  • Merchantability;

  • Fitness for a particular purpose;

  • Noninfringement;

  • Accuracy;

  • Availability;

  • Business success;

  • Particular results.

We do not guarantee that:

  • The service will always be available;

  • Every error will be corrected;

  • User content will generate traffic or revenue;

  • Analytics will be completely free from invalid or automated traffic;

  • Third-party links will remain available;

  • A referral, advertisement, or promotion will achieve a specific result.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

22. Limitation of Liability

To the maximum extent permitted by law, KLM Enterprises Services LLC and its owners, officers, employees, contractors, affiliates, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

  • Use or inability to use the service;

  • Loss of data;

  • Loss of revenue or profit;

  • Lost business opportunities;

  • Unauthorized access;

  • User Content;

  • Third-party services;

  • Account suspension;

  • Service interruptions;

  • Referral, contest, advertising, or analytics results.

To the maximum extent permitted by law, our total liability for all claims connected with the service will not exceed the greater of:

  1. The amount you paid directly to The Underlinks during the 12 months before the event giving rise to the claim; or

  2. One hundred U.S. dollars.

These limits do not apply where liability cannot legally be limited.

23. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless KLM Enterprises Services LLC and its owners, officers, employees, contractors, affiliates, and agents from claims, damages, losses, liabilities, and reasonable expenses arising from:

  • Your User Content;

  • Your use of the service;

  • Your violation of these Terms;

  • Your violation of the law;

  • Your infringement of another party’s rights;

  • Products, services, promotions, or advertisements offered through your page;

  • Disputes between you and your customers, visitors, followers, or business partners.

We may control the defense of a matter subject to indemnification, and you agree to reasonably cooperate.

24. Governing Law and Venue

These Terms are governed by the laws of the State of Missouri and applicable United States federal law, without regard to conflict-of-law rules.

Before filing a legal claim, the parties agree to attempt in good faith to resolve the dispute by written notice and direct communication.

Unless applicable law requires otherwise, legal proceedings relating to these Terms or the service must be brought in a state or federal court with jurisdiction in or serving Jackson County, Missouri.

Each party consents to the personal jurisdiction of those courts.

25. Changes to These Terms

We may update these Terms to reflect:

  • Changes to services;

  • New features;

  • Security requirements;

  • Business practices;

  • Payment procedures;

  • Legal or regulatory obligations.

Updated Terms will be posted with a revised “Last Updated” date.

When required, we will provide additional notice before a material change becomes effective.

Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.

26. General Provisions

Entire Agreement

These Terms and incorporated policies constitute the entire agreement regarding the service unless a separate written agreement applies.

Severability

If a provision is found invalid or unenforceable, the remaining provisions will continue in effect.

No Waiver

Failure to enforce a provision does not waive the right to enforce it later.

Assignment

You may not assign your rights or obligations without our written consent. We may assign these Terms as part of a business transfer, restructuring, or sale.

Headings

Headings are provided for convenience and do not change the meaning of these Terms.

Electronic Communications

You agree that notices and agreements may be provided electronically, subject to applicable law.

Survival

Provisions concerning ownership, payments, disclaimers, liability, indemnification, disputes, and other terms that logically should survive will continue after account closure.
